To make matters more confusing, nine states (including California, Washington, and Colorado) let residents buy cannabis-based products with or without THC. Nearly two dozen other “medical marijuana states” allow the sale of cannabis, including capsules, tinctures, and other items containing CBD or THC, at licensed dispensaries to people whose doctors have certified that they have an approved condition (the list varies by state but includes chronic pain, PTSD, cancer, autism, Crohn’s disease, and multiple sclerosis). Sixteen more states legalized CBD for certain diseases. But because all these products are illegal according to the federal government, cannabis advocates are cautious. “By and large, the federal government is looking the other way,” says Paul Armentano, deputy director of the Washington, DC–based National Organization for the Reform of Marijuana Laws (NORML), but until federal laws are changed, “this administration or a future one could crack down on people who produce, manufacture, or use CBD, and the law would be on its side.”

It’s important to note that each state has its own individual laws on possession limits. Many states now have their own laws on the books for CBD oil specifically. Tennessee, for example, has made cannabis oil legal if it’s derived from hemp rather than marijuana. As Professor Elliot Altman of the Botanical Medical Research Center at Middle Tennessee State University, explains, “The legal definition is hemp is less than point three percent THC which is the psychotropic agent. Marijuana is point three percent or greater.” (14)
Specific city and county laws have been enacted to regulate how citizens and tourists may possess and consume marijuana. Penalties exist for driving while under the influence of marijuana. Someone driving under the influence of marijuana is considered impaired in both Colorado and Washington when five nanograms per milliliter (ng/mL) of blood or more of active THC is detected.

There is significant preliminary research supporting the potential therapeutic value of CBD, and while it is not yet sufficient to support drug approval, it highlights the need for rigorous clinical research in this area. There are barriers that should be addressed to facilitate more research in this area. We appreciate the opportunity to testify on the potential use of CBD for therapeutic purposes. The good news is that in 2017, the National Institutes of Health funded cannabinoid research to the tune of $140 million, including $15 million on CBD. The F.D.A. also loosened restrictions on CBD research in 2015 and has announced that it is considering “pathways” to allow the sale across state lines of CBD in food and beverages, sales now confined to states that have approved CBD use.
While experts — including Cargile, Romanowski, and Carqueville — note that there hasn’t been a ton of research done on the potential risks of CBD oil, it’s thought to be a pretty low-risk product. “First of all, using anything topically reduces the risks right off the bat,” Cargile says. “There’s not a lot of research, however CBD and THC, cannabis and hemp have been used for thousands of years. And according to the Centers for Disease Control [and Prevention], which reports deaths in this nation, [marijuana] causes zero deaths every year so it’s found to be very safe.”
In addition to fighting inflammation in the body, CBD oil may reduce anxiety by directly affecting the brain. Studies have found that CBD actually lowers activity in the amygdala and increases prefrontal cortex activation, two parts of the brain involved in anxiety. There is also evidence that CBD is able to activate hippocampus neurogenesis, aka regenerate new neurons! This activates CB1 receptors, which has a positive balancing impact on GABA and glutamate levels, associated with reducing anxiety.
A wealth of marketing material, blogs and anecdotes claim that cannabis oils can cure whatever ails you, even cancer. But the limited research doesn't suggest that cannabis oil should take the place of conventional medication, except for in two very rare forms of epilepsy (and even then, it's recommended only as a last-resort treatment). And, experts caution that because cannabis oil and other cannabis-based products are not regulated or tested for safety by the government or any third-party agency, it's difficult for consumers to know exactly what they're getting.
In addition to that, data from statistics have demonstrated that CBD oil and anxiety are amongst the most explored subjects on the web, that is as far as cannabis-related treatments and restorative medicines are concerned. Particular studies on CBD oil anxiety, have soar exponentially during previous years. This is present-day evidence that traditional cannabis treatments are starting to rise, and in fact, numerous individuals are as of now receiving the rewards of the hemp-based compound.
In addition to the research on the use of cannabinoids in palliative treatments for cancer—reducing pain and nausea and in increasing appetite—there are also several pre-clinical reports showing anti-tumor effects of CBD in cell culture and in animal models.xxviii These studies have found reduced cell viability, increased cancer cell death, decreased tumor growth, and inhibition of metastasis (reviewed in McAllister et al, 2015).xxix These effects may be due to the antioxidant and anti-inflammatory effects of CBD;xxx however these findings have not yet been explored in human patients. There are multiple industry sponsored clinical trials underway to begin to test the efficacy of CBD in human cancer patients.
With that said, I'm definitely intrigued enough by the subtle effects to continue taking the oil and possibly even to up the dosage to the recommended two full droppers of the 30mL bottle per day for a week or so. Plus, I take comfort in knowing that it's an all-natural treatment for anxiety that's responsibly grown on family farms in Colorado. Something that's safe, legal, requires no prescription, and makes me less anxious, less scatterbrained, and more focused? I'm definitely on board.
